1. Service Agreement

By requesting towing or roadside assistance services from TowMania ("the Company"), you ("the Customer") agree to these Terms and Conditions. TowMania provides towing, roadside assistance, vehicle recovery, and related automotive services in Ottawa, Ontario, Canada and surrounding areas.

Services are provided on a per-request basis. Each service request constitutes a separate agreement governed by these terms. TowMania reserves the right to refuse service at its sole discretion for safety or operational reasons.

2. Pricing and Payment

TowMania provides upfront pricing before dispatching any service vehicle. The quoted price is final and includes all applicable charges unless the scope of work changes upon arrival at the service location. Any changes to the original scope will be communicated and approved by the Customer before additional charges are incurred.

Payment is due upon completion of service. We accept cash, major credit cards (Visa, Mastercard, American Express), and debit cards. For customers with applicable insurance coverage, TowMania may bill the insurance company directly, subject to the insurer's approval and payment terms.

3. Liability Limitations

TowMania carries comprehensive commercial insurance covering damage to customer vehicles during towing and transport operations. In the event of damage caused by TowMania's negligence during service, the Company will repair or compensate for the damage up to the fair market value of the vehicle.

TowMania is not liable for: pre-existing damage to vehicles; damage caused by the vehicle's mechanical condition; personal property left inside towed vehicles; delays caused by weather, traffic, or circumstances beyond TowMania's control; indirect or consequential damages arising from service delays or interruptions.

Customers must report any damage claims within 24 hours of service completion. Claims made after this period may not be honored.

4. Vehicle Storage

If a towed vehicle is delivered to a TowMania-affiliated storage facility, storage fees begin 24 hours after delivery. Storage rates are posted at the facility and will be communicated to the Customer at the time of towing. Vehicles not claimed within 30 days may be considered abandoned and processed according to Ontario's Repair and Storage Liens Act.

5. Cancellation Policy

Customers may cancel a service request at no charge before a TowMania vehicle has been dispatched. Once a service vehicle has been dispatched, a cancellation fee equal to 50% of the quoted service price may apply. If the service vehicle has arrived at the Customer's location, the full service fee applies regardless of whether the service is completed.

6. Customer Responsibilities

The Customer is responsible for providing accurate information about the vehicle location, vehicle type, and nature of the problem. The Customer must ensure they have legal authority to request towing of the vehicle. TowMania will not tow vehicles without proper authorization from the registered owner or their authorized representative.

7. Privacy of Customer Data

TowMania collects and uses customer personal information in accordance with our Privacy Policy and applicable Canadian privacy legislation including PIPEDA. Customer data is used solely for service delivery, billing, and communication purposes. See our Privacy Policy for full details.

8. Governing Law

These Terms and Conditions are governed by and construed in accordance with the laws of the Province of Ontario and the federal laws of Canada applicable therein. Any disputes arising from these terms shall be resolved in the courts of Ontario, in the judicial district of Ottawa.

We aim to resolve all disputes fairly and promptly. If a resolution cannot be reached directly, either party may pursue mediation or legal remedies available under Ontario law.

10. Amendments

TowMania reserves the right to modify these Terms and Conditions at any time. Changes take effect upon posting to our website. Continued use of TowMania's services after changes constitutes acceptance of the modified terms.
